Trailytics Terms & Conditions

These Terms & Conditions ("Terms") govern your access to and use of Trailytics (the "Service"). By creating an account, clicking "I agree," or using the Service, you agree to these Terms.

1) Eligibility

You must be at least 13 years old to use the Service. If you are using the Service on behalf of an organization, you represent you have authority to bind that organization.

2) Account registration and security

• You are responsible for maintaining the confidentiality of your credentials.
• You agree to provide accurate information and keep your account information updated.
• You are responsible for activity that occurs under your account.

3) User content (uploads) and permissions

• You retain ownership of the photos and content you upload ("User Content").
• By uploading User Content, you grant Trailytics a limited license to host, store, process, reproduce, and display your content only as needed to operate the Service and provide features to you (e.g., detection, analytics, forecasting).
• You represent that you have all rights needed to upload the content and that your uploads do not violate any laws or third-party rights.

4) Prohibited use

You agree not to:

• Upload content you do not have the right to share.
• Use the Service to violate laws, regulations, or third-party rights.
• Attempt to reverse engineer, bypass security, abuse rate limits, or disrupt the Service.
• Upload malicious code, or use the Service to distribute malware.
• Use automation in a way that harms the Service or other users.

We may suspend or terminate accounts involved in prohibited activities.

5) Platform output is informational (no guarantees)

Trailytics provides analytics, predictions, and forecasts that are estimates. Outputs may be incomplete, inaccurate, or unavailable.

You understand and agree:

• Forecasts and detections are not guaranteed.
• You remain responsible for your decisions and actions (including hunting-related decisions).
• The Service does not provide legal, safety, or professional advice.

6) Subscriptions, trials, and fees (if applicable)

If the Service offers paid tiers:

• Fees, limits, and included features are described within the platform.
• Usage limits may apply (e.g., monthly uploads/jobs).
• We may change plan features or pricing with notice as required by law.

(If you're not billing yet, keep this section but note "Paid plans may be introduced later.")

7) Termination

You may stop using the Service at any time and may delete your account where available.

We may suspend or terminate access if:

• You violate these Terms,
• Your use creates risk or legal exposure for Trailytics,
• We must do so to comply with law.

8) Privacy

Our Privacy Policy explains how we collect and use information. By using the Service, you acknowledge the Privacy Policy.

9) Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILYTICS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

10) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRAILYTICS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO TRAILYTICS IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR $100 IF YOU HAVE NOT PAID ANY AMOUNTS), UNLESS REQUIRED OTHERWISE BY LAW.

11) Changes to the Terms

We may update these Terms. If changes are material, we'll provide notice within the Service. Continued use after changes become effective means you accept the updated Terms.
